Human Rights and Civil Integration Committee deliberating on Draft Law on DNA Database

According to the Deputy Minister of Internal Affairs, Aleksandre Darakhvelidze, the establishment and functioning of a DNA database in Georgia require legal regulations. Consequently, through legislative amendments, a legal framework will be created for the formation of a DNA database.

“With the adoption of the draft law, a DNA database will be created within the National Bureau of Forensic Expertise named after Levan Samkharauli, which will store genetic profiles as defined by the Law of Georgia on the DNA Database”, - said Aleksandre Darakhvelidze.

The draft law defines the grounds and conditions for the creation and operation of a DNA database.

Specifically, a DNA database will be established within the Bureau to store genetic profiles for the purpose of crime prevention, solving and investigating crimes, as well as facilitating the identification of missing persons.

The draft law also specifies the individuals subject to biological sample profiling. It will be mandatory to profile the biological samples of accused/convicted persons for registration in the DNA database. Additionally, the DNA database will include genetic profiles collected from individuals, corpses, crime scenes, or other material objects, following the procedures established by Georgian legislation during the investigation phase of a criminal case.

Furthermore, the registration of any person’s genetic profile in the DNA database will be allowed with their consent. As noted by the presenter, it will be possible to transfer genetic profiles to other states and international organizations, as well as to request and include genetic profiles processed by foreign state agencies in Georgia’s DNA database. The draft law, which the committee supported, is a legislative initiative of the government.
