The suspension of the constitutional act appointing a member of the High Council of Justice is an unprecedented interference in the powers of the President. Giorgi Mskhiladze, the Parliamentary Secretary of the President of Georgia, said this at the briefing.

“An unprecedented thing has happened in the history of Georgia. This time, the judiciary of Georgia directly and illegally interfered with the constitutional powers of the President and suspended the constitutional act appointing a member of the High Council of Justice, while the President of Georgia has full authority according to the Constitution of Georgia to independently make a decision to select and appoint a member of the High Council of Justice.

First, you have no right to this arbitrariness;
Second, it is a violation of the principle of separation of powers;
Thirdly, this is another proof of the clan rule of the court, for which even a single dissenting opinion is not acceptable in the High Council of Justice.

This is an unprecedented interference in the constitutional powers of the President, unacceptable for the constitutional order of Georgia. We appeal to the society, the diplomatic corps, international community, international organizations, OSCE/ODIHR, whose representatives observed the process of selecting the candidate for the member of the High Council of Justice, it was a transparent process. We appeal and call on everyone to respond appropriately to this issue”, - said Giorgi Mskhiladze.

According to the decision of the Tbilisi City Court, the decree of the President of Georgia of July 15, 2024 on the appointment of Kakha Tsikarishvili as a member of the High Council of Justice has been suspended.
