The Strasbourg court confirmed Giorgi Mamaladze’s guilt in the main part of the lawsuit and upheld it. Such a statement released the Prosecutor’s Office of Georgia, while commenting the judgment issued by the European Court of Human Rights in the case of Giorgi Mamaladze v. Georgia.
“Moreover, the European Court found that the evidence was obtained correctly and also, the procedure of using this evidence against him was not flawed
The court found 2 violations in the lawsuit of Giorgi Mamaladze, which are related to the violation of the presumption of innocence by the public officials and the closing of the trial.
Accordingly, there are no question marks regarding the guilt of Giorgi Mamaladze. In addition, as the European Court concludes that Article 6, paragraph 1 of the Convention had not been violated, which implies obtaining and using evidence in the investigation process.
As for the violations, the relevant agencies will respond, if necessary. Along with this, Mamaladze was refused compensation for moral damages, and instead of the GEL 800,000 requested as compensation, the state was ordered to pay GEL 9,000”, - reads the statement.
Mamaladze was arrested in early February 2017 at the Tbilisi international airport, with police officers discovering cyanide poison in his belongings during the search. The interior ministry later said the clergyman had plotted the murder of Shorena Tetruashvili, the patriarch’s secretary.
The cleric refused to plead guilty and said Tetruashvili and other high-ranking clerics had planned his arrest due to his possession of information about financial violations at the patriarchate.
