Based on the motion of the Prosecution Service, Tbilisi City Court terminated criminal prosecution against the defendant charged with attempted murder of a Polish tourist I.K. due to his mental incompetence and imposed mandatory psychiatric treatment on him.
Investigation carried out by the Ministry of Internal Affairs of Georgia has established that on July 5, 2021, in Tbilisi, the defendant attacked the Polish citizen I.K., who was in Georgia on a tourist visit, for no reason and with hooligan motive. In order to murder I.K., the defendant stabbed him with a knife in different parts of the body, causing him life-threatening injuries. Thanks to prompt medical care, the Polish citizen was saved.
Law enforcement officers arrested the defendant on the same day. He was indicted under Article 19, 109 §2 (c) (attempted murder with hooligan motive) of the Criminal Code of Georgia. The investigation has also ascertained that the defendant had mental problems and, therefore, a psychiatric evaluation was ordered over the course of the investigation to determine his level of mental competence.
The report of the complex psychiatric and psychological evaluation conducted for the case has revealed that the defendant suffers from a chronic mental illness – paranoid schizophrenia (ICD-10 CM Code: F20.0). Hence, he was unable to realize his actions when committing the crime. Considering his mental state, the defendant is incapable of being accountable for himself, testifying and participating in investigative and judicial actions. Moreover, his mental state hinders the serving of sentence, since he cannot make a conscious decision and there is a danger of him harming himself and others and the risk of threats and violent behavior. Thus, relying on the examination report, the defendant needs mandatory psychiatric treatment.
In this light, based on the motion of the Prosecution Service, Tbilisi City Court imposed mandatory treatment at a mental facility on the defendant.
